What Is Export Control and Why Do You Need It?

If you import or export goods that may seem “technically complex” or “strategically important,” there is a risk that customs authorities will request an Export Control (EC) conclusion at the border. This is especially likely if the goods fall under the category of dual-use items (meaning they can be used for both civilian and military purposes).
Since September 2024, regulatory practices in this area have changed in Kazakhstan. Requirements for Export Control have become stricter, and penalties have increased. Making mistakes or delaying document submission has become risky.

What is Export Control (EC)?

Export control is a government review of goods to determine their purpose and field of application. The goal is to ensure that the products:
  • are not used for military or dangerous purposes
  • are not classified as dual-use goods
  • do not violate Kazakhstan’s international obligations (for example, non-proliferation regimes)
If a product is considered “potentially sensitive,” you must obtain an official conclusion from the Industry Committee confirming that it does not require special permits.

When is Export Control required?

  • When exporting or importing specific goods
  • During re-export, transit, or processing of goods outside Kazakhstan
  • If customs authorities or a bank are unsure whether the goods are on the controlled list
  • If the HS code (TN VED code) raises questions or does not fully reflect the nature of the goods

What goods fall under export control?

Examples include:
  • Electronic components and chips
  • Software and encryption equipment
  • Industrial machinery, lasers, optics
  • Chemicals that could be used for military purposes
  • Anything that can be used in the creation of WMD (weapons of mass destruction), missiles, or delivery systems
Important: Even if goods are for civilian use, their technical characteristics or application area may attract the attention of regulatory authorities.

What documents are required?

For EC processing, we will request from you:
  • Invoice or proforma invoice (indicating the manufacturer and end recipient)
  • Technical product description: what the product is, its specifications, where and how it is used
Everything else is handled by us:
  • Application to the authorized authority
  • Cover letter with explanations
  • Communication with the Industry Committee until a response is received

How long does the process take?

Usually 8 business days, in rare cases up to 17.

Why is it important to submit documents in advance?

If your goods are subject to control but you do not have a conclusion:
  • The shipment may be detained at the border
  • Fines or confiscation may be imposed
  • In some cases, there may even be administrative or criminal liability
