False Declaration of Goods

As of September 4, 2024, amendments to Article 551 of the Code of Administrative Offenses of the Republic of Kazakhstan — “False Declaration of Goods” — came into force.
Now, liability for false customs declarations is calculated not as a fixed amount in MCI (monthly calculation index), but as a percentage of unpaid duties and taxes.

What Has Changed

  • Instead of previous fines ranging from 30–150 MCI (and up to 300 MCI for repeat violations), a percentage-based scale is now applied.
  • Legal entities and individual entrepreneurs are fined 25% of unpaid customs payments, including taxes, special, anti-dumping, and compensatory duties. For repeat violations — 50%.
  • For individuals failing to declare cash, the fine is also 25% of the undeclared amount, with confiscation of undeclared funds. Previously, the fine was 10 MCI.

Important Notes

  • Fines can be applied not only for deliberate underpayment of duties, but also for errors, typos, incorrectly filled fields, or improper completion of declarations.
  • Even formal inaccuracies are now treated as violations, leading to additional charges and fines.
Monitor carefully: Any mistake can now be costly.
